A Salinas woman who repeatedly molested a teenage boy over the course of several years will spend the next few months in jail after she admitted she failed to register as a sex offender while on an extended vacation in Miami.
Annette Banda, also known as Annette Vink, had been ordered by her probation officer to register with the Miami police department while she was on an extended trip to Florida with her family. She admitted to the probation violation during a hearing in Monterey County Superior Court in August.
The 51-year-old Banda, who had received only probation after she admitted to the ongoing sexual assault on the victim, could have faced five years, eight months in prison—if the judge made good on the promise to impose that sentence if she violated probation.
Instead, Superior Court Judge Mark Hood today ordered her remanded to jail for a total of 500 days.
Because she already served a certain number of days while undergoing psychiatric evaluation before she was originally sentenced to probation, that number was chopped to 135 days in jail. She will only end up serving about half that time.
Hood also reinstated her on probation, extended the probation to Aug. 16, 2020 and ordered her to attend twice monthly sex offender counseling, an order previously made that Banda apparently ignored, claiming she hadn't found the time, according to Assistant District Attorney Jeannine Pacioni.
"If this was a male who sexually assaulted a female of that age and with that duration, we wouldn't be having this conversation," Pacioni says.
Banda began sexually molesting the victim in 2010, when he was 14. The abuse continued for several years. The boy was a family acquaintance. She pleaded no contest to committing lewd acts on a child and having unlawful sexual intercourse with a child.
