Richard Rosen and Mario Mottu, Sr.

Mario Mottu, Sr., right, and his attorney Richard Rosen appear in court.

King City's former police Chief Dominic Baldiviez and former cop Mario Mottu Sr. received three years probation and a 30-day jail sentence Wednesday in connection to the embezzlement of a city-owner patrol car.

Badiviez took a plea deal in July after a two-week trial ended with a hung jury. With that deal, he admitted to a misdemeanor embezzlement charge and one count for obstructing a peace officer when he lied to investigators.

The embezzlement charges for both stem from a police car that was approved to go to the police department's explorer program, but ended in the possession of Mottu Sr. The paperwork authorizing the vehicle's transfer carried Baldiviez's signature.

Initially, Baldiviez admitted to investigators the signatures were his, but claimed he did not remember signing the document. In trial, the former police chief changed his story and claimed his signature was forged.

Mottu Sr. was the director of the explorer program, and when he turned the patrol car into a show car for his own personal use, he used funds from the program to modify the vehicle, prosecutors say. The court order Mottu on Wednesday to return the vehicle's title back to King City.

Baldiviez and Mottu were two of the six King City police officers arrested in February 2014. Five of those cops have taking plea deals with prosecutors and have admitted to lesser charges.

Former King City Police Officer Bobby Carrillo, the alleged mastermind behind a for-profit towing scheme that targeted mostly immigrants, will begin his trial in January.
