The city of Monterey, using an outside law firm, launched an investigation into former city manager Mike McCarthy on Nov. 29, 2017, after a disgruntled husband sent an email to the city the day prior, alleging McCarthy was having an affair with his wife, who was also a city employee.
That investigation concluded May 9, and while its findings are confidential—unless made public by the Monterey City Council—the council's May 15 closed-session agenda states there are four cases of "anticipated litigation" based on "the existing facts and circumstances known to potential plaintiffs" that were uncovered in the investigation.
On the morning of May 15, in advance of that meeting, Monterey City Attorney Christine Davi said no claims have yet been filed with the city related to McCarthy, but that it was incumbent upon her to inform council of the potential litigation.
Davi, citing confidentiality protections related to personnel matters, could not offer more details, including the genders of those potential plaintiffs.
KSBW was first to report the anticipated litigation, which it did on the evening of May 15. That report used footage from a Jan. 5 interview with Interim City Manager Hans Uslar, discussing the allegations of "sexual improprieties" related to McCarthy.
That was the same day the Weekly broke news of those allegations. KSBW, which had the scoop, never reported it until now.
