The collective v. dispensary debate is heavily skewed in Marina due to a Draconian interpretation of Prop. 215 and SB 420 (“Marina medical pot collective ignores police notice to cease and desist operations,” June 6-12). Inaction by the City Council and gross bias by Marina PD has led to a Catch-22. The conversation about opening a dispensary is barely getting off the ground, and in response the city has decided to go after people who are legally providing medical marijuana to collective members who cannot grow their own. If current state law regarding cultivation of medical cannabis for patients is ignored then perhaps it is time to peer into the constitutionality of city ordinance 2006-06, and following revisions.

SB 420 recognizes the right of patients and caregivers to associate collectively or cooperatively to cultivate medical marijuana and protects patients and caregivers from arrest for transportation and other miscellaneous charges not covered in 215. Regardless of anyone’s personal feelings about the use of medical cannabis, the way Marina is going after Kevin Saunders and Nobia Monsauret is similar to the concept of mass gun confiscation or any other gross breach of personal rights in the name of “safety.” - Representing Reality | via Web

Well, citizens of Marina, how can you allow this mindless man and his girlfriend, whom states her husband died of cancer, to do business in your city? In the line of work I do I come across many Marina residents anywhere between the ages of 15 and above. Always the same story: “I use medical marijuana for back pain.” Every Tom, Dick and Harry has legal marijuana use for the most minor aches and pains. Mr. Saunders, have you heard of simple Tylenol? Yes maybe a handful of cancer patients benefit, but thanks to you, the others are just plain potheads who cannot contribute to society because their (sic) brain is so delayed! If you ever had a good argument you ruined it by your racist, uneducated comments. - DisgustedCitizen | via Web

Dear Disgusted: The City of Marina hasn't gone after anyone. "Marina is going after Kevin Saunders and Nobia Monsauret." Saunders launched his pitch for a Marina dispensary by offering to bust the Mayor in the face and "knock his teeth down his throat," ignoring the advise of those who kindly suggested that he do a proper Council presentation on the merits of his project first.
He could have provided a slideshow to Council and contacted them individually to show them his business plan, and made appointments with the City Manager and development staff, but he chose to begin with threats and hurtful personal insults towards the Mayor and his fiancee, now wife, Natalie.
His continued rude behavior at Council public comment period finally called for his removal by police, which was ordered by the Mayor pro-tem, who hasn't the superhuman level of leniency and extreme tolerance of Mayor Delgado, known to say nothing more than, "thanks Gary," when threatened with a bullet in the back of the head by former appointed Mayor Gary Wilmot.
Saunders continues to rant against the current Mayor and Council for a ban on marijuana dispensaries put in place by former Mayor Ila Metee McCutchon years ago. His approach is a textbook example of how not to change law, especially curious for a student of Monterey College of Law.
