On the surface, it doesn’t look like much: A couple renting a home sues their landlords and property manager over defects on the property.

But a closer look at Don and Molly May’s lawsuit reveals a set of allegations that, if true, add up to more than a typical renter’s complaint.

As detailed in court documents, the story begins in February 2014, when the couple asked Carmel property manager Vivian Kent to help them find a rental in Pebble Beach. Within days, the Mays inked a 41-month lease to rent a home owned by San Francisco residents Clay Couri and James Durham.

In the Mays’ complaint, filed last month, they state Kent ensured them “everything was in working order,” and that damaged countertops (described as “unusable”) would be replaced by their move-in date.

According to the Mays, who pay $3,100 per month in rent, the countertops weren’t replaced by move in and the home had numerous other defects they discovered only after moving in.

The complaint lists 45 alleged defects ranging from petty (missing closet rod) to annoying (“microwave does not warm food”). The Mays allege there’s an alarm system that goes off spontaneously, a garage door that opens randomly and a generator that turns itself on for no reason.

Kent, the property manager, says the Mays’ complaint is baseless. “I can prove everything they’re claiming is bogus,” she says.

Responding to allegations she failed to follow through on her initial assurances, she says: “If I was doing the things they claim, I would not be in business today.”

The homeowners have not yet filed a response to the complaint, but Durham says it will refute the Mays’ claims. “Just about everything in there, there’s an answer for,” he says. “A great deal of it is moot.”

A first hearing in the case is scheduled for Sept. 15 in Monterey County Superior Court.
