Panetta cosponsors a bill that would require Trump to pay back tariffs on Canadian goods.

Rep. Jimmy Panetta, D-Carmel Valley, has signed on to a “BAD DEAL”—that is, the acronym for a bill that intends to rein in the president’s tariff-making authority.

In response to President Donald Trump’s trade war with Canada, Rep. Brad Schneider, a Democrat from Illinois, introduced the Banning Antiquated Duties and Delivering Equitable American Levies (BAD DEAL) Act on Aug. 27.

Trump recently announced a 50-percent tariff on about $20 billion in Canadian goods, while Canada reacted with retaliatory tariffs of its own on American goods.

Trump imposed the tariffs based on Section 338 of the Tariff Act of 1930, which allows the president to enact tariffs on another country to “offset the burden or disadvantage from a foreign country's discrimination against or unequal imposition on the commerce of the United States.”

Schneider’s proposed bill would repeal Section 338, and at the same time, require a refund all of the money collected under this authority.

Panetta is one of seven cosponsors of the bill, all Democrats.

“This Administration’s senseless tariff policies and self-defeating trade wars have already hurt American businesses and raised costs for working families,” Panetta said in a statement. “It is long past time for Congress to reclaim its constitutional authority over trade and put an end to this Administration’s destructive tariff regime.”

The bill has been referred to the Republican-controlled House Committee on Ways and Means.
